The Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65
or the Act) requires the Governor to publish, and update at least
annually, a list of chemicals known to the State to cause cancer
or reproductive toxicity. The Office of Environmental Health Hazard
Assessment (OEHHA) is the lead agency for the implementation of
Proposition 65.
On December
4, 1998, OEHHA published a notice in the California Regulatory Notice
Register (Register 98, No. 49-Z) announcing its intent to list
certain chemicals under Proposition 65 in accordance with the regulatory
criteria in Section 12306 of Title 22 of the California Code
of Regulations. The publication of the notice initiated a 30-day
public comment period which would have closed on January 4, 1999.
OEHHA has received requests from interested parties seeking an extension
of the comment period to allow for the submittal of complete and
relevant scientific information. OEHHA hereby extends the public
comment period to 5 p.m., Tuesday, January 19, 1999.
OEHHA notes that this extension of the 30-day public comment period
does not affect the 60-day period that OEHHA is required to wait
from publication of the notice of intent to list a chemical until
actual listing of a chemical. Accordingly, OEHHA may still list
any or all of the affected chemicals on the Proposition 65 list
on or after February 2, 1999.
